Terms of Service & Trade
The legal framework governing quotation, project execution, and workmanship warranties with Detailed Gibstopping Limited.
1. Application of Terms
These Terms of Service & Trade apply to all trade quotations, contracts, sub-contracts, and interior finishing services provided by DETAILED GIBSTOPPING LIMITED (“the Contractor”) to any client, builder, or property owner (“the Client”).
2. Quotations and Acceptance
- All written quotes remain valid for thirty (30) days from issuance, unless otherwise stipulated.
- Acceptance of a quotation constitutes a binding trade contract and agreement to these terms.
- Quotations are formulated on the assumption that framing is straight, plumb, and aligned within tolerances specified in NZS 3604:2011, and that moisture content does not exceed 18%.
3. Site Access & Environmental Readiness
The Client or Head Contractor is responsible for ensuring:
- Unrestricted, safe physical access to all work areas during regular operating hours (Monday to Saturday).
- A weather-tight building envelope with fully installed roof, glazing, and external cladding.
- Continuous electrical power (230V) and potable water on site.
- Adequate heating or ventilation during cold or high-humidity periods to permit normal compound drying and curing.
4. Scope Variations & Additional Work
Any modifications to the agreed scope (including repairing third-party plasterboard fixing faults, upgrading from Level 4 to Level 5 skim coat, or patching unforeseen structural damage) will be treated as a formal variation. Variations will be documented in writing and added to the progress invoice.
5. Progress Invoicing & Payment Schedule
- Invoices are issued in New Zealand Dollars (NZD) including GST as required by the Goods and Services Tax Act 1985.
- For residential contracts exceeding $2,000, milestone progress payments apply: 30% deposit upon confirmation, 40% upon completion of compound application, and 30% balance upon final dustless sanding and hand-over.
- Payment is strictly due within seven (7) days of invoice date, unless special 20th-of-month commercial terms have been agreed in writing.
6. Workmanship Warranties & Consumer Guarantees
We warrant that all stopping, jointing, and plasterboard fixing work will be executed with reasonable care and skill in accordance with AS/NZS 2589:2017. Nothing in these terms excludes statutory protections provided to residential consumers under the Consumer Guarantees Act 1993 or the Building Act 2004.
